Chief Emeka Atuma of the All Progressive Congress, APC, was declared ineligible for the Abia Central senatorial election by the Court of Appeal sitting in Owerri.

The court, presided over by Justice Rita Pemu, directed INEC to recognise Hon Sam Onuigbo as the victor and legitimate candidate of the APC primary election for Abia Central senatorial district.

Onuigbo, who represents the Ikwuano/Umuahia federal district in the House of Representatives, had appealed the previous decision by Justice Evelyn Anyadike of the Federal High Court sitting in Umuahia, which recognised Atuma as the flag bearer, through his Counsel, Muhammed Ndarani Mohammed, SAN.

The Appellate Court granted Onuigbo’s petitions and confirmed the legitimacy of the party primary conducted on May 28, 2022, which resulted in Onuigbo receiving the most votes.

During the primary, Onuigbo triumphed over his sole opponent, Chief Henry Ikoh, who was later named Minister of State for Science and Technology.

However, Atuma, who did not participate in the primary, was eventually recognised by the APC as its genuine candidate, a decision that Rep. Onuigbo contested in the Umuahia federal high court.

Meanwhile, in response to the Appellate Court’s decision, Onuigbo stated that the judiciary has remained the saviour of Nigeria’s democracy.
