The Supreme Court on Thursday, September 29, ruled in favour of Senator Ademola Adeleke, the Governor-elect of Osun State, stating that he is the genuine candidate of the Peoples Democratic Party, PDP, in the state’s gubernatorial election which took place on July 16.
The Supreme Court, in a unanimous decision by a five-member panel of justices, dismisses an appeal lodged against Adeleke by Prince Dotun Babayemi, who claimed the PDP governorship ticket, after emerging from a parallel primary election held by a faction of the party in the state.
Mr. Adebayo Adelodun, SAN, counsel for the appellant, withdrew the appeal after the panel led by Justice Amina Augie pointed out that the case was statute barred.
The panel had maintained that the appeal was incompetent, citing the fact that it was filed after the law’s 14-day deadline.
