COURT: Suit Against Stella Oduah’s Candidacy Thrown Out

A Federal High Court in Abuja has dismissed a suit filed against Senator Stella Oduah seeking to invalidate her Peoples Democratic Party senatorial candidacy for Anambra North Senatorial District.

The plaintiff’s suit, filed by John Emeka, a PDP senatorial aspirant in the May 27 primary, was dismissed by Justice Inyang Ekwo for being status barred.

Emeka had sued Oduah, the PDP, and INEC as the first, second, and third defendants, alleging that Oduah lied under oath in her expression of interest and nomination forms.

The plaintiff also claimed that Oduah used the same information under oath in previous general elections as the PDP’s candidate for Anambra North Senatorial District in 2015 and 2019.

On October 13, Justice Ekwo scheduled a hearing on the case for today.

Emeka prayed the court in the originating summons marked: FHC/ABJ/CS/841/2022, dated and filed on June 8 by his lawyer, Mbanefo Ikwegbue, to declare that the information supplied by Oduah in her INEC Form CF001 regarding her participation in the National Youth Service Corps (NYSC) scheme was false.
He claims that the act violates Sections 12(1)(a)(b)(c) and 13(1)(a) of the NYSC Act.

Emeka prayed the court in the originating summons marked: FHC/ABJ/CS/841/2022, dated and filed on June 8 by his lawyer, Mbanefo Ikwegbue, to declare that the information supplied by Oduah in her INEC Form CF001 regarding her participation in the National Youth Service Corps (NYSC) scheme was false.
He claims that the act violates Sections 12(1)(a)(b)(c) and 13(1)(a) of the NYSC Act.

He also asked the court to rule that because of the false information she provided on her INEC Form CF 001 regarding her participation in the NYSC Scheme, she was ineligible to run in the aforementioned elections or any other election to the Nigerian Senate.
