A lawsuit brought by the National Association of Nigerian Students (NANS) to force the Academic Staff Union of Universities (ASUU) and the Federal Government to end the ongoing strike action was dismissed by the National Industrial Court (NIC), Abuja, on Tuesday.
Following the withdrawal of the lawsuit by the NANS factional President, Umar Faruk Lawal, Justice Polycarp Hamman closed further proceedings in the case.
Lawal had informed the court that he filed the suit marked NICN/ABJ/273/2022 for himself and on behalf of NANS, but when the case came up on Tuesday, Lawal informed the court that he had filed a motion to dismiss.
He stated that his decision to withdraw the suit was motivated by NANS’s challenge, which questioned his standing and denied that he was the President of the Student Body, as he had deposed to.
Though the other two respondents were not represented, Marshal Abubakar, counsel for ASUU, informed the court that he was not opposed to Lawal’s application to withdraw the suit.
As a result, Justice Hamman dismissed the case.
